Harrison Township Zoning Board
Meeting Minutes
April 13, 2015
The Harrison Township Zoning Board’s April, 2015 meeting was called to order by chair Kelly Spriggs at 8:00pm. Members present were Kelly Spriggs, Ronde Cook-Brushart, Doug Czako, James Wells, Trevor Younkin, Debi Hulse and Joe DeFelice.
Debi read the minutes from the January 12, 2015 meeting. The minutes were approved as read.
Old Buisness
Joe DeFelice reported findings of a question from the Zoning Appeals Board. The question of whether a Zoning Member must be present or if the Board could hold a tele-communication conference was answered. The board will need to have a quorum present to hold a meeting. The meetings are public meetings and open to the public and members of the Board must be present.
Joe also gave a report of on-going problems. The Danny Bailey property has not been resolved. Nothing has been done and it is getting worse. Joe called Jamie at the Prosecutor’s Office. The Office has not made contact with them as of yet.
Davina Martin is still in violation of the zoning. The neighbors have pictures that show there is still someone residing there. Jamie of the Prosecutor’s Office has been contacted regarding this matter. The Martin’s have an attorney. It is in the Prosecutor’s hands.
There is still no evidence at the Burdock’s There was a truck at the residence, but nobody saw anything being unloaded.
On the abandonment issue: Are there any ordinances? Pickaway County has no ordinance regarding abandoned buildings. The Ohio Trustee Association’s Winter 2014 Conference had a session addressing this issue. Kelly Spriggs gave everyone copies of ORC 505.86 and ORC 505.87.
ORC 505.86 is the Removal, repair or securance of insecure, unsafe buildings or structures. ORC 505.87 is the Abatement, control, or removal of vegetation, garbage, refuse, and other debris.
According to the Ohio Revised Code, the fire department would have to deem a structure unsafe and the Health Department would need to deem a structure uninhabitable.
The question of whether this was a zoning issue or a Trustee issued was discussed. It has already been established in the ORC as a township issue. If there is a problem, the zoning board could make a request to the Trustees to enforce the code.
Ronde made a motion, 2nd by Doug that the Renick Property on US 23 be referred to the Township Trustees. It has been empty and abandoned for years. The Zoning Board wishes that the Trustees enforce ORC 505.86 by first sending a letter to the property owner to bring the property up to code. ORC 505.86 and ORC 505.87 need to be enforced. All present voted to recommend this. There were none against.
Kelly discussed an ordinance from Granger Township, Medina County. This ordinance deals with Non-functioning cell towers. This ordinace states that the Operator should remove unused towers within 6 months of discontinuing use. When built, the bond issued is $100 per vertical foot. The Board discussed this. We will see what happens with the Verizon Tower which is supposed to be built in Harrison Township.
Joe DeFelice updated the map. It is framed and is on the wall.
