HEARING MINUTES

April 15, 2019

The Harrison Township Zoning Appeals Board held 2 Variance Hearings on Monday, April 15, 2019 at 7:00pm at the Harrison Township Building, 2746 Weigand Road, Lockbourne, OH  43137.

Leah Black, Chairman opened the hearing at 7:00pm.  Present were:  Leah Black, Peg Egbert, Frank Miles, Kenny Cookson, Buck Spangler, Debi Hulse and Dale Hoover.  Also present were:  John Smith, applicant for Hearing #2, Keane Arbogast, Robin Moore, applicant for Hearing #1, Gary L. Moore, and Kevin Hulse.

Hearing 1:

Robin Moore of 3535 Miller Road, Ashville, OH  43103, applied for a Variance to open an Online Florist business in her home.  Parcel #D1200080000600.

Debi Hulse, Secretary, read the Legal Notice which was published in The Circleville Herald.

Dale Hoover, Zoning Inspector, briefly stated that the applicant, Robin Moore, wished to open an Online Florist Business in her home at 3535 Miller Road, Ashville, OH  43103.  Dale stated that he had heard no complaints regarding this application.  He believes that the neighbors will experience no difference in traffic after the business opens.  The applicant has also requested that a sign be place at the entrance to her home.  Dale Hoover stated that the sign may no larger than 2 square feet.

Robin Moore spoke.  She stated her desire to open the business.  She has been an employee of a local florist.  That floral business is now closed. 

Leah Black, Chairman, asked if she would have items available to pick up at the business.  Robin stated that in the future there would be merchandise for in person sales.  Robin stated that 95% of the now closed, local florist’s business was ordered on line. 

Frank Miles asked how many cars they anticipated would be in and out of the driveway per day.  The answer was no more than 1 – 2 cars per day.  The area would experience no increase in traffic as a result of this business.

Peg Egbert moved to accept this variance.  Frank Miles 2nd.  All members voted to accept the Variance.  Leah Black announced that the vote was unanimous and that Robin Moore could open her business.

The Harrison Township Zoning Appeals Board held 2 Variance Hearings on Monday, April 15, 2019 at 7:00pm at the Harrison Township Building, 2746 Weigand Road, Lockbourne, OH  43137.

Leah Black, Chairman opened the hearing at 7:00pm.  Present were:  Leah Black, Peg Egbert, Frank Miles, Kenny Cookson, Buck Spangler, Debi Hulse and Dale Hoover.  Also present were:  John Smith, applicant for Hearing #2, Keane Arbogast, Robin Moore, applicant for Hearing #1, Gary L. Moore, and Kevin Hulse.

Hearing 2:

John E. Smith of 10877 Lockbourne Eastern Road, Ashville, OH  43103, applied for a Variance to build a pole barn 8 feet from the property line. 

Debi Hulse, Secretary, read the Legal Notice which was published in The Circleville Herald.

Dale Hoover, Zoning Inspector, stated that John E. Smith wanted to build a garage 8 feet from the property line.  Current Zoning Regulations require 25 feet from the property line.  The lots in that area are smaller than the current required lot size.  Other buildings in that area are closer than 25 feet from the line.  This building would not look different than others in that area.  Dale Hoover stated that he received 1 call on this application.  That 1 call came from someone residing on Duvall Road.  The caller inquired about the location of the residence.  The caller had no problems with the application.

John E. Smith stated that he wanted to build a 24’ X 24’ Pole Barn.  The barn would match the house.  He stated that he was 22 feet on either side to the property line.  He has a tile in the back of the property which helps drain the water.  He did not want to disturb it.

Leah Black, Chairman, stated that she was glad that the property owners were concerned with the drainage tile. 

Keane Arbogast who is a neighbor on the side where the building will be built stated he had no objection to John Smith building this building.

John Smith and Keane Arbogast both stated that the modifications made to the ditch on Lockbourne Eastern road have greatly improved the water problems on their properties. 

Frank Miles moved to accept the Variance to build the building.  Kenny Cookson 2nd the motion.

Leah Black, Chairman, called for a vote.  Voting:  A Yes vote would be to accept the variance.

Buck Spangler            Yes

Leah Black            Yes

The Board voted unanimously to accept the Variance.  Chairman Leah Black announced that John E. Smith could apply for a Building Permit. 

Peg Egbert moved to adjourn the hearing.  Kenny Cookson 2nd the motion.  Hearing was adjourned
